1. Agreement
These Terms of Service (“Terms”) are an agreement between you and the provider of Vorklog (“we”, “us”) covering the Vorklog mobile app for iOS and Android (the “App”) and this website (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. What Vorklog is — and isn't
Vorklog is a personal tool for recording your own working time and estimating what it earns you, across one or more jobs.
Vorklog is not payroll, HR, legal, tax or financial software or advice. Hours, overtime and earnings are calculated from the times, rates and working hours you enter, and are estimates only. They don't account for taxes, deductions, or the pay rules in your contract or collective agreement. Your employer's official records and payslips decide what you are actually paid.
We are not a party to your employment or any agreement with your clients, and we can't resolve pay disputes. You may use your Vorklog records as a personal reference, but you are responsible for checking them.
3. Who can use Vorklog
You must be at least 16 years old and able to enter into a binding agreement to create an account. The Service is for personal use by one person per account.
4. Your account
- Give us accurate information and keep your email address up to date.
- Keep your password secure and don't share your account.
- You are responsible for activity in your account.
- Tell us straight away at support@vorklog.com if you think someone has accessed your account without permission.
5. Subscriptions and payment
Some or all features of the App require a paid subscription. The plans, prices and included features are shown in the App and the store before you buy.
- Billing. Subscriptions bought in the App are sold and billed by Apple (App Store) or Google (Google Play), under their terms, and charged to your store account.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends.
- Cancelling. Manage or cancel your subscription in your Apple ID or Google Play subscription settings. Cancelling stops future renewals; you keep access until the end of the period you've paid for. Deleting the App or your Vorklog account does not cancel a subscription.
- Free trials. If a plan includes a free trial, it converts to a paid subscription when the trial ends unless you cancel before then.
- Refunds. Refunds are handled by Apple or Google under their refund policies. This doesn't affect any rights you have under consumer law.
- Price changes. If we change the price of your plan, you'll be told in advance through the store, and the change applies from your next billing period.
6. Your content
The jobs, work sessions, notes and other information you enter (“Your Content”) belong to you. You give us permission to store, process and display Your Content only as needed to provide the Service to you.
You are responsible for Your Content and for having the right to enter it. How we handle personal data is explained in our Privacy Policy.
7. Acceptable use
When using the Service, you agree not to:
- use it for anything unlawful, or to record other people's working time without their knowledge;
- try to access other users' data or any part of the Service you're not authorised to use;
- interfere with, overload or disrupt the Service or its security;
- copy, modify, reverse engineer or resell the Service, except where the law expressly allows it;
- create accounts by automated means or under false pretences.
8. Our intellectual property
The Service, including its software, design, text and the Vorklog name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in line with these Terms and the rules of the store you downloaded it from.
9. Changes and availability
We keep improving Vorklog, so features may be added, changed or removed. We aim to keep the Service available and reliable, but we can't guarantee it will always be uninterrupted or error-free. If we make a change that significantly reduces what a paid plan includes, we'll tell you in advance.
10. Ending your use
You can stop using Vorklog at any time and ask us to delete your account as described in our Privacy Policy.
We may suspend or close your account if you seriously or repeatedly break these Terms, or if the law requires it. Where reasonable, we'll warn you first.
11. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”. We don't promise that calculations of hours, overtime or earnings will match what you are owed or paid, because they depend on the information you enter and on rules outside Vorklog. Keep your own records of anything important.
12. Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, or for lost wages, income or pay disputes arising from your use of the Service;
- our total liability for any claim relating to the Service is limited to the amount you paid for it in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the mandatory rights the law of your country gives you.
13. App Store and Google Play
If you downloaded the App from Apple's App Store, you and we acknowledge that these Terms are between you and us only, not with Apple, and that:
- we, not Apple, are solely responsible for the App and its content;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price (if any). Apple has no other warranty obligation for the App;
- we, not Apple, are responsible for handling any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims;
- you confirm that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the App from Google Play, Google's terms of service also apply to your use of Google Play.
14. Changes to these Terms
We may update these Terms. We'll change the date at the top, and if a change is significant, we'll tell you in the App or by email before it takes effect. If you keep using the Service after that, the new Terms apply. If you don't agree, you can stop using the Service and delete your account.
